hi all, im new here but i have a problem and i hope someone can shed some light on this. I was with orange broadband and talk talk offered us free broadband and my dad wanted us to change over so fine we did. Talk talk said they would sort out getting the MAC code and soth out cancelling the account with orange so we left them to it. We went live with no problems and all was good.
A few months later i recieved a letter from orange asking for £182.00 for cancelation and that i didnt notify them changing to talk talk and why didnt i ask for a mac code. I told orange that i was unaware of this and that talk talk had promised to sort this out. I spoke to talk talk and they said they didnt need a mac code because they were giving us free broadband. Anyway i contacted OFCOM and they said talk talk have done an illegal migration and that orange shouldnt of charged me this money. When i spoke to talk talk they actually told me the dates and times of when they contacted orange of the change and they authorised it so orange are trying to pull the wool over my eyes!!! i sent orange a letter saying i wasnt going to pay them the money and they sent one back giving me two options how to pay my outstanding bill!!! grrrrrrrr anyone else had this problem??? |

Yes - exactly the same problem. Talk talk say they have contacted Orange, Orange denying this and still charging / threatening legal action. Haven't thought about writing to Ofcom - will now though - thanks,

I am having exactly the same problem. I told Orange that was changing to Talktalk and ask for a migration code. The change over went well. Two months later I was charged 30.00 for an illegal migration. Subsequently I was told to today that if I didn't pay them they would take legal action to recover the money. I am also writing to Ofcom.

i am so glad im not the only one, my current situation is that i need a deadlock letter from orange,i have filled out a form for cisas and will send that off. My advice would be to contact ofcom and get the number for cisas also you need to include the details of the complaint to cisas so write a letter stating when you took the contract out and when your contract started with talk talk. Orange cannot charge you for a service that you didnt use as it would be impossible to run two ISP's on any one line so state this also to orange and i was told by ofcom that they are not allowed to charge a cancellation fee if you choose to leave because they didnt provide a service that you were promised. Orange promised to give me 8meg but i only got 2meg because my line wasnt compatible but they didnt tell me this when i took the contract so i have every right to leave

The only way Orange could do this was if your still in the contract period, they can ask for the balance of payments up to the contract expiry, so if your 4 months into a yearly contract with Orange, and move somewhere else (does not matter who) they can send you a bill for 8 months.
If of course your out of your contract, then they could say you need to give 30 day notice (or what ever period your contract says) and they can say they will not accept this notice from a third party, so in effect they could charge you for whatever this notice period is. Although the LLU operators can move your line without a MAC, it is for the customer to send notice to your current provider. So they can either charge you to the end of your contract, or for the notice period, and in some cases depending on your contract they can charge a cancellation fee (if not a true migration but a cease and re-provide) although this can only be a reasonable amount (the £30 someone quoted in this thread could be deemed a reasonable amount) but not £180! |

ok let me explain my complaint. I moved over to talk talk because orange didnt provide the service that was promised to me. They offered me a package which was 8meg. My internet slowed right down after i paid for the package, so i called them and they said i was only getting 2meg because my line wasnt compatible. But when i took the package they told me that my line WAS compatible so as a customer i have every right to move and they should not charge me for it.
