Call logs supplied by the service provider, Telecom One Ltd indicated that complainants had ‘opted-in’ to a weekly joke club upon dialling an 0871 number substantially earlier than the date at which they actually received chargeable messages. A complaint was also received from a member of the public who had obtained a copy of their mobile telephone bill from their mobile operator, pertaining to the date and time a subscription was alleged by the service provider. This complainants’ mobile bill did not contain evidence that a call had been made on this date or time.
