During the course of its investigation, PhonepayPlus became concerned that consumers had received marketing messages or charged text messages without providing full verifiable opt-in confirmation, and that consumers were not being provided with sufficient details of the service (i.e. how it worked, how much it cost and what was being offered to users). In addition, PhonepayPlus was concerned about the identity of the Information Provider as the individuals involved appeared to have historically been involved in non-compliant services.

now that appears to me that ppp are describing theft.....and what do they mean by 'consumer'.....consumer of what?

at least they have 'ordered' the 'information provider' to issue 'refunds'

What surprised me about this is why PPP waited until they had amassed 450 complaints about a service, dating back almost a year, before they bothered to take any action.

Were they waiting for more revenue to accrue, to allow for bigger fines?

And, without being sympathetic to the culprit, isn't it rather double jeopardy to fine the IP twice for the same set of breaches with different SPs?

The Information Provider also stated that the marketing of the service was achieved through working with a company called Froggie S.L. in order to invite users to the service. Furthermore, the service was promoted by a combination of text message marketing, and via the website poinc.tv and http://pointfactory.co.uk.
