Telespazio actually asked and obtained from the Internationl Telecommunication Union (ITU) in 1998 the “88213” virtual country code to serve the European Mobile Satellite network (EMSAT), with professional mobile satellite applications.

The mobile Network Operators (GSMA) and Telespazio and other companies in the value chain all share the revenue generated from this global multimillion dollar missed-call billing fraud. That may explain the apparent lack of action and reluctance in shutting down the fraud.


If you are receiving missed-calls from 88213 or any other International or Premium Rate number there are no shortage of National/International Regulators to complain to. If they claim it is not their responsibility to address the problem then they are lying.
The Regulators have the ability and the legal authority (responsibility) to identify and shut down the companies that misuse networks to cause consumer harm.

The IARM initiative, which has been advised on by ex-UK watchdog (PhonepayPlus) chief George Kidd, has the support of the Mobile Entertainment Forum and the Mobile Marketing Association.

Speaking in Australia, Kidd said: “The mobile payments market has the potential to soon besoon to four or five times the size it is today. Consumer trust is the critical factor.

IARN The International Audiotex Regulators' Network, IARN, was set up in 1995. IARN has established guidelines for the minimum standards that may be expected to apply to not only domestic premium rate services but also cross-border (0011) and global premium international rate services (979) when provided between IARN member countries.

The complaints handling provisions provide an interesting model for co-operation between member countries and are based on Art 3 of the European Union’s E-commerce Directive which states that the service is subject to the law applicable in the country of origin of the service.
The regulator in the country of the complainant:
* is to be the first and main point of contact for any consumer with a complaint
.
* must identify the country of origin of the service complained about and the relevant national regulator and then hand over the complaint to that regulator for investigation.
* must keep the complainant informed on progress and the final outcome of the complaint
* is responsible for chasing up the other regulator to ensure that the investigation proceeds.

Article 3

Internal market

1. Each Member State shall ensure that the information society services provided by a service provider established on its territory comply with the national provisions applicable in the Member State in question which fall within the coordinated field.

2. Member States may not, for reasons falling within the coordinated field, restrict the freedom to provide information society services from another Member State.

3. Paragraphs 1 and 2 shall not apply to the fields referred to in the Annex.

4. Member States may take measures to derogate from paragraph 2 in respect of a given information society service if the following conditions are fulfilled:

(a) the measures shall be:

(i) necessary for one of the following reasons:

- public policy, in particular the prevention, investigation, detection and prosecution of criminal offences, including the protection of minors and the fight against any incitement to hatred on grounds of race, sex, religion or nationality, and violations of human dignity concerning individual persons,

- the protection of public health,

- public security, including the safeguarding of national security and defence,

- the protection of consumers, including investors;

(ii) taken against a given information society service which prejudices the objectives referred to in point (i) or which presents a serious and grave risk of prejudice to those objectives;

(iii) proportionate to those objectives;

(b) before taking the measures in question and without prejudice to court proceedings, including preliminary proceedings and acts carried out in the framework of a criminal investigation, the Member State has:

- asked the Member State referred to in paragraph 1 to take measures and the latter did not take such measures, or they were inadequate,

- notified the Commission and the Member State referred to in paragraph 1 of its intention to take such measures.

5. Member States may, in the case of urgency, derogate from the conditions stipulated in paragraph 4(b). Where this is the case, the measures shall be notified in the shortest possible time to the Commission and to the Member State referred to in paragraph 1, indicating the reasons for which the Member State considers that there is urgency.

6. Without prejudice to the Member State's possibility of proceeding with the measures in question, the Commission shall examine the compatibility of the notified measures with Community law in the shortest possible time; where it comes to the conclusion that the measure is incompatible with Community law, the Commission shall ask the Member State in question to refrain from taking any proposed measures or urgently to put an end to the measures in question.

CHAPTER II

PRINCIPLES

Section 1: Establishment and information requirements

Article 4

Principle excluding prior authorisation

1. Member States shall ensure that the taking up and pursuit of the activity of an information society service provider may not be made subject to prior authorisation or any other requirement having equivalent effect.

2. Paragraph 1 shall be without prejudice to authorisation schemes which are not specifically and exclusively targeted at information society services, or which are covered by Directive 97/13/EC of the European Parliament and of the Council of 10 April 1997 on a common framework for general authorisations and individual licences in the field of telecommunications services(28).

Article 5

General information to be provided

1. In addition to other information requirements established by Community law, Member States shall ensure that the service provider shall render easily, directly and permanently accessible to the recipients of the service and competent authorities, at least the following information:

(a) the name of the service provider;

(b) the geographic address at which the service provider is established;

(c) the details of the service provider, including his electronic mail address, which allow him to be contacted rapidly and communicated with in a direct and effective manner;

(d) where the service provider is registered in a trade or similar public register, the trade register in which the service provider is entered and his registration number, or equivalent means of identification in that register;

(e) where the activity is subject to an authorisation scheme, the particulars of the relevant supervisory authority;

(f) as concerns the regulated professions:

- any professional body or similar institution with which the service provider is registered,

- the professional title and the Member State where it has been granted,

- a reference to the applicable professional rules in the Member State of establishment and the means to access them;

(g) where the service provider undertakes an activity that is subject to VAT, the identification number referred to in Article 22(1) of the sixth Council Directive 77/388/EEC of 17 May 1977 on the harmonisation of the laws of the Member States relating to turnover taxes - Common system of value added tax: uniform basis of assessment(29).

2. In addition to other information requirements established by Community law, Member States shall at least ensure that, where information society services refer to prices, these are to be indicated clearly and unambiguously and, in particular, must indicate whether they are inclusive of tax and delivery costs.

Section 2: Commercial communications

Article 6

Information to be provided

In addition to other information requirements established by Community law, Member States shall ensure that commercial communications which are part of, or constitute, an information society service comply at least with the following conditions:

(a) the commercial communication shall be clearly identifiable as such;

(b) the natural or legal person on whose behalf the commercial communication is made shall be clearly identifiable;

(c) promotional offers, such as discounts, premiums and gifts, where permitted in the Member State where the service provider is established, shall be clearly identifiable as such, and the conditions which are to be met to qualify for them shall be easily accessible and be presented clearly and unambiguously;

(d) promotional competitions or games, where permitted in the Member State where the service provider is established, shall be clearly identifiable as such, and the conditions for participation shall be easily accessible and be presented clearly and unambiguously.

Article 7

Unsolicited commercial communication

1. In addition to other requirements established by Community law, Member States which permit unsolicited commercial communication by electronic mail shall ensure that such commercial communication by a service provider established in their territory shall be identifiable clearly and unambiguously as such as soon as it is received by the recipient.

2. Without prejudice to Directive 97/7/EC and Directive 97/66/EC, Member States shall take measures to ensure that service providers undertaking unsolicited commercial communications by electronic mail consult regularly and respect the opt-out registers in which natural persons not wishing to receive such commercial communications can register themselves.

I mean: The case is crystal clear. It is fraud. And this fraud is possible because of the blindness of the companies involved. But... there seem to be no laws in the telemedia sector. Telemedia mob.

That was written in May 2004.
But in June 2004 they offered (see above)

So they asked the international network providers to implement the Antarctica code for the scientists - and then reserved numbers for premium rate services???

In July 2004 PROTON ENTERPRISES LLC started doing business in Italy.

The same lies that happened with EMSAT numbers...
We remember: in a statement from EMSAT/Eutelsat it was clearly said that no audiotext services should be allowed using the EMSAT codes.

That's not necessary... It is a communication within the RIPE/NCC mailing list - but there is that document about Antarctica numbers, and it's written by the same Richard Hill who was informed about the international scam - and just did nothing.
They know that someone is in breach of the ITU laws, but they do not care. That's nothing new or special, but it's worth being mentioned.

The Antarctica code was given from ITU to Mr Fink with clear rules and limitations - but who did care about the rules being broken?

Better save your time and think about writing some posts in whocallsme to lead the victims or the media to The Scream. This scam should be investigated by ITU and by the police.

Yesterday I've been in touch with a German friend who had a communication with Global Networks Switzerland about the possible (mis)use of Antarctica numbers (0088234) for ping scam. It seems as if GNS has nor knowledge nor any benefit from this. The responsibility may be somewhere else. Only a police investigation could find out what's going on.
I want to take the opportunity to tell you that Mr F* from GNS answered very elaborated and should be seen as above suspicion in that case - if it actually is a case.
I'll get the details about the communication in the course of the week.

Together with Mr Roger Stebler he is running Globalibilling at the famous PO Box 146, Road Town, Tortola, BVI (not only sharing the post box but also - in former times - the IP with a certain Telconline Inc which is on the "refusal list" and therefore must not get any PR number)

intermatica is said to be investigating - but it looks as if the fraudsters cooperate with national carriers.

Antarctica spam is over? Strange that Antarctica numbers could have been used, because they are not given away by the owner of the numbers. So ANY traffic running via Antarctica MUST be rogue traffic. So why can companies offer Antarctica numbers for audiotex services? This must be scam at all.

Got an email asking me to call back at this number. A little googling showed that the number belongs to the EMSAT satellite network operated by Telespazio S.p.A. in Italy. There are also reports of people being charged as much as 9 Euro/min for calling these numbers.
